FG DEVELOPMENT – Purchase Agreement

By completing a purchase, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree to these terms, do not complete your purchase.

1. DEFINITIONS
   - "Member" means any individual who has joined this Discord server and clicked the Verify button, thereby gaining access to channels, resources, and community features.
   
   - "Customer" means any Member who has expressed interest in, inquired about, or initiated contact regarding the purchase of Products or Services.
   
   - "Purchaser" means any Member or Customer who has completed a financial transaction and purchased Products or Services from FG Development.
   
   - "Developer" means FG Development, its owners, operators, contractors, affiliates, and authorized representatives who create, maintain, distribute, or provide support for Products and Services.
   
   - "Digital Assets" means all files, resources, textures, models, configurations, documentation, templates, and any other digital materials created or provided by Developer, whether as standalone products or as part of custom development work.
   
   - "Products" means any Digital Assets, pre-made scripts, resources, or packaged materials made available for purchase or download.
   
   - "Services" means custom development work, commissioned projects, technical support, consulting, configuration assistance, troubleshooting, or any other service-based offering provided by Developer.
   
   - "Labor and Conversion Services" means the time, skill, technical effort, and expertise applied by Developer in sourcing, evaluating, converting, optimizing, texturing, configuring, and formatting raw or third-party assets into usable Digital Assets compatible with FiveM and the GTA V platform. This is the primary product of value being exchanged in any transaction with FG Development.
   
   - "Intellectual Property" means all copyrights, trademarks, trade secrets, patents, proprietary methods, source code, designs, concepts, and any other protected materials owned or created by Developer.
   
   
   
   
2. INTELLECTUAL PROPERTY AND LICENSE
   
   All Products and Digital Assets are protected under United States copyright law and California state law. Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the Product solely for your own personal or server use. You do not own the Product. You own a license to use it.
   
   Unauthorized copying, redistribution, resale, sharing, leaking, uploading to public repositories, reverse engineering, de-compiling, or extracting source code is strictly prohibited. Removing credits or claiming authorship of any Product is strictly prohibited. Any violation will result in immediate license revocation and potential legal action.
   
   ALL SALES ARE FINAL
   
   Pursuant to California Civil Code Section 1694, all sales of Digital Assets constitute sales of intangible personal property and are final and non-refundable. No refunds, reversals, credits, or exchanges will be issued under any circumstances, including but not limited to dissatisfaction with Products, change of mind, server closure, project cancellation, technical incompatibility, lack of technical knowledge, non-usage, or buyer's remorse.
   
   CHARGE-BACKS AND PAYMENT DISPUTES
   
   Initiating a charge-back or payment dispute constitutes a material breach of this Agreement. In the event of a charge-back, all licenses will be permanently revoked, you will be banned from all FG Development services, and Developer reserves the right to pursue recovery of funds and damages.
   
   DELIVERY AND SUPPORT
   
   Products are delivered electronically immediately upon purchase completion. Delivery constitutes fulfillment of the sale. Products are provided "as is" without warranty of any kind. Developer does not guarantee that Products will be error-free, compatible with all systems, or suitable for your specific use case. Support is not included unless explicitly purchased separately.
   
   LIMITATION OF LIABILITY
   
   To the maximum extent permitted by California law, Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, loss of data, server downtime, or business interruption. Developer's total liability shall not exceed the amount you paid for the Product.
   
   ACCEPTANCE
   
   By completing your purchase, you represent that you are at least 18 years of age or have parental consent, and you agree to be legally bound by these terms. This constitutes a binding agreement between you and the Ownership/Developers of FG Development.
